1. Who we are
Zybercomply ("the Service") is operated by iThing AB, a company registered in Sweden ("we", "us", "iThing"). By using the Service you are entering into an agreement with iThing AB.
2. Acceptance
By creating an account, accessing or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms. The Service is intended for users of legal age.
3. The Service
Zybercomply provides AI-assisted threat modeling tooling aligned to prEN 40000-1-2 §6.4, STRIDE methodology and ETSI TS 102 165-1 risk scoring, including report generation. The exact features available depend on your subscription plan.
4. Accounts and credentials
You must provide accurate information when registering and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
5. Acceptable use
You must not, and must not allow anyone else to:
- use the Service unlawfully or for fraudulent or deceptive purposes;
- send spam or infringe the intellectual property or privacy rights of others;
- upload malware, attempt to probe, scan, or breach the security of the Service;
- scrape, reverse engineer, resell or redistribute the Service or its outputs;
- circumvent technical limits, quotas, or access controls.
6. AI features and outputs
- You are responsible for the prompts and inputs you submit, for how you use the outputs, and for verifying their accuracy before relying on them.
- You must have the necessary rights to any content you submit for processing.
- You must not use the Service to generate illegal content, deepfakes, hate speech, malware, content that sexualises minors, or to attempt to jailbreak underlying models.
- Outputs may be inaccurate or incomplete. The Service is a decision-support tool and is not a substitute for qualified professional advice. Outputs must be reviewed by a competent person before being used in regulated assessments.
- We may remove or restrict content, refuse or filter outputs, and suspend accounts where we reasonably believe these Terms have been violated. Repeated infringement of third-party rights will result in account termination. Rights-holders may contact us at conny@zyber.se for takedown requests.
7. Intellectual property
iThing AB retains all rights, title and interest in and to the Service, including the software, models, documentation and branding. Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. As between you and iThing, you retain ownership of content you submit; you grant us a limited licence to host and process it solely to provide the Service.
8. Payments, subscriptions and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewal, cancellation and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. See our Refund Policy for our money-back guarantee.
9. Service availability
We work to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your right to use the Service ends; we may delete your account data after a reasonable export window.
11. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service is capped at the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.
12. Indemnity
You agree to indemnify and hold iThing AB harmless from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.
13. Changes
We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of Sweden. The courts of Sweden have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to any mandatory consumer protection laws of your country of residence.
